This Privacy Policy describes how Indianapolis Metropolitan Planning Organization (“IMPO,” “we,” “us,” or “our”) collects, uses, and shares information about you (“user,” “you,” or “your”). This Privacy Policy applies to Personal Information we may collect when you access or use our website, https://indympo.gov/, (“Website”) or any other website, mobile applications, and related services we control on which we may place this Privacy Policy (collectively, the “IMPO Services”). This Policy also describes how we and others may use Personal Information, under what circumstances we may disclose Personal Information to third parties, and the instances in which we may allow third parties to collect information directly. Depending on your activities when using or accessing the IMPO Services, you may from time to time be required to agree to additional terms and conditions.

Our Services are hosted in and directed at individuals in the United States. If you are located outside of the United States, you should not access or use the IMPO Services and should not share your Personal Information with us.

By using the IMPO Services, you agree to the terms of this Privacy Policy and our Terms of Use. If you do not agree with this Privacy Policy, please do not use our Services. We reserve the right to update this Privacy Policy at any time. The last updated date above provides you with notice that the Privacy Policy has been updated.

Please note that this Privacy Policy applies to anyone who uses or accesses the IMPO Services, regardless of whether you use the IMPO Services via a computer, mobile device, tablet, or other medium (collectively, your “Equipment”).

This Policy applies to information we collect:

  • On our Website.
  • In email and other electronic messages between you and IMPO via the IMPO Services.

This Policy does not apply to information collected by:

  • Us through any website, content, application, or service we may offer which does not link to this Privacy Policy.
  • Any third party, including through any application or content (including surveys and advertising) that may link to or be accessible from or through our Website or the IMPO Services.

1. INFORMATION WE MAY COLLECT

We may collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual (“Personal Information“). Personal Information does not include information that is publicly available or de-identified, which we can collect and use for any purpose.

We collect the following information:

  • Identifiers. Such as first and last name, postal address, Internet Protocol (IP) address, email address, telephone number, or other similar identifiers.
  • User Records Information. Such as name, signature, address, telephone number,  age, education, employment, employment history, or other similar information provided through our forms.
  • Internet or other similar network activity. Such as your browsing history and information on your interactions with our Website, email, or advertisements. For example, this may include searches you have made, Services you have accessed, your IP address, browser type and version, time zone setting, location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access the Services, the pages you’ve viewed or engaged with before or after using the IMPO Services, and other actions on the IMPO Services, including the pages or content you view and links you click to third-party applications.
  • Geolocation data. Such as the city or zip code of your location when you use our Services.
  • Sensitive Personal Information. Such as your precise geolocation or information regarding your racial or ethnic origin through forms or surveys you choose to complete through the Website.
  • Other information you choose to give us. Such as information you share with us in surveys or other free text fields.

2. HOW WE COLLECT INFORMATION

We collect information about our Users in the following ways:

Directly from you. For example, when you complete forms, surveys, or comments on our Website; access or use our products and services; provide feedback or request customer service; sign up for a newsletter; share your comments, photos, videos, or other information to the IMPO Services or when you review us; or when you otherwise communicate with us.

Automatically from your devices. When you access or use the IMPO Services, information associated with you and/or your Equipment may automatically be collected or received through device-based tracking technologies such as cookies, pixels, tags, beacons, scripts, or other technology.

From third parties. We may receive information about you from vendors and service providers we hire to help us run our business, including the companies that host or operate our Website, send emails for us, or host our content. We may also obtain Personal Information about you from search information providers, business partners, sub-contractors, credit reference agencies, data brokers, or aggregators. Additionally, other users of the IMPO Services may provide us with your Personal Information so we may invite you to use the IMPO Services.

3. COOKIES AND OTHER DATA COLLECTION TECHNOLOGIES

We automatically receive and store certain types of Personal Information whenever you interact with the IMPO Services. For example, we use “cookies,” “web beacons,” (also called “clear gifs” or “pixel tags”) and “embedded scripts” to obtain certain information when you use or access the IMPO Services. We use information collected from these technologies to

  • Estimate our audience size and usage patterns.
  • Store your preferences so we can customize the IMPO Services according to your individual interests.
  • Speed up your searches.
  • Recognize you when you return to the IMPO Services.

We also use Google Analytics to analyze use of our Services. This information is used solely to improve our Website. This information is not used for purposes of commercial advertising or behavioral profiling.

Cookies. Cookies are small files that we transfer to your Equipment’s local drive or your web browser memory to enable our systems to recognize your browser and to provide convenience and other features to you. We use cookies to provide additional features or functionality to your experience when you use the IMPO Services, such as storing your preferences and other information about you when you use the Website. You may block or limit the storage of cookies via browser controls or other software. You may also delete cookies manually from your device through your internet browser, operating system, or other programs. Please note that some portions of the IMPO Services may not function properly or be available if you block or delete certain cookies.

Web Beacons. Web Beacons are tiny graphics with a unique identifier, similar in function to cookies, and may be used to track the online movements of users, when an email has been opened, and to provide other information.

Embedded Scripts. Embedded Scripts are pieces of code written directly into a website’s code to add functionality or interactivity to a webpage.

4. HOW WE USE & SHARE INFORMATION

Use and Disclosure of Personal Information

We may use or disclose information for the following purposes, including automated processing activities:

  • To operate, maintain, and improve the IMPO Services.
  • To provide you with services.
  • Manage our relationship with you which may include notifying you about changes to the IMPO Services, Terms, Privacy Policy, or services, asking you to provide feedback or take a survey, or addressing any questions you may have about our services (e.g., to provide legal updates, administrative notices, etc.).
  • Respond to your requests from us or to fulfill any other purpose for which you provide it.
  • With your consent for any other purpose as may be permitted by law or that we describe when you provide the information.
  • To comply with any court order, law, or legal process, including responding to any government or regulatory request.
  • To enforce our Terms of Use, this Policy, or other applicable policies or agreements with you.
  • To protect the rights, property, or safety of our business, employees, customers, or others. This includes exchanging information with other companies and organizations for the purposes of cybersecurity, fraud protection, and credit risk reduction.
  • To verify identities and prevent fraud, abuse, or prohibited conduct.
  • To investigate suspected violations of any law, rule or regulation, or the terms or policies for our website.

To Whom We Disclose Personal Information

IMPO may sell or share your Personal Information only as described below:

  • Service Providers, Contractors, and Third Parties. We share Personal Information with vendors who process data on our behalf that help us with certain services, including user support, research and analytics, data processing, management, analytics, fraud prevention (including account access authentication), and survey administration.
  • Law Enforcement, Regulators, Courts, and other Governmental Authorities. We may share any of the categories of information we collect, pursuant to applicable law, to respond to subpoenas, court orders, legal process, and other law enforcement measures, to comply with other legal obligations, to respond to an emergency, or otherwise to protect our or the rights, property, safety, or security of other parties, visitors to or users of the IMPO Services, or the public.
  • With Your Consent. We may share your Personal Information when you choose to connect to Third Party Services or otherwise authorize sharing, as permitted by law.

5. INFORMATION RIGHTS

IMPO maintains its records and information in accordance with the Indiana Access to Public Records Act and applicable record-retention laws. Certain records may be required to be retained or disclosed notwithstanding individual requests to access, delete, or limit use of information. Individuals may contact IMPO to request access to or correction of information, subject to applicable law.

6. RETENTION

We will retain and use your Personal information for the period necessary for the specified purposes for which we collect it to comply with our legal obligations, resolve disputes, and enforce our agreements, as is required by Indiana law. Following the expiration of the retention period, Personal Information will be deleted.

7. DATA SECURITY

The security of your Personal Information is very important to us. We use appropriate physical, electronic, and administrative safeguards designed to protect your Personal Information from loss, misuse, and unauthorized access, alteration, or disclosure. However, the Internet environment is not 100% secure, and we cannot guarantee that Personal Information we collect will never be accessed in an unauthorized way.

8. MINORS’ INFORMATION

We do not intentionally seek to gather information from individuals under the age of thirteen (13). Absent a few limited exceptions, it is illegal under the Children’s Online Privacy Protection Act (COPPA) for websites to knowingly obtain personally identifiable information from a child under the age of 13 without parental consent. As such, children under the age of 13 are prohibited from submitting personally identifiable information to the Website without parental consent. We encourage parents and guardians to provide adequate protection measures to prevent minors from providing information unwillingly on the internet.

9. THIRD-PARTY WEBSITES AND TOOLS

Our Website and the IMPO Services may contain links to third-party websites or third-party communications tools. For example, the IMPO Services may contain links to and from the websites of our partner networks, co-sponsors of projects or promotions and affiliates, or plug-ins enabling third-party features. In addition, our “Job Opportunities” page may contain links to GovernmentJobs.com, where you may apply for specific job openings. If you follow a link to any third-party website or engage a third-party plug-in, please note that these third parties have their own privacy policies and that we do not accept any responsibility or liability for these policies or any activities of such third parties. This Privacy Policy only applies to our Website and the IMPO Services. If you click a link on our Website or through the IMPO Services that takes you to another website which we do not control, you should review their policies before sharing information with that site.

10. MATERIAL CHANGES TO THIS PRIVACY POLICY

As noted above, we may update this Privacy Policy from time to time, and we will provide notice of any material changes to the Privacy Policy as required by law. All changes will be effective upon posting of the updated Privacy Policy on our Website. If you object to any change, you can stop using our Services. Continued use after the effective date constitutes acceptance of the revised policy.
